Necessity of Restorative Justice Practices in Bangladesh

Introduction

Restorative Justice is a very innovative and efficient movement in modern justice system. Backlog of cases and large pecuniary scale of traditional justice system is one of the major reason for becoming this new system more effective. Large time duration is also a major reason for it. In our social justice system still we don't have any formal organization relating  with the Restorative Justice for repairing the harm and to promote the victim's right. So for the better practice of social justice along with the shade of the government and to raise the slogan of "creating we feeling", we need to think about that perspective. As a student of victimology and Restorative Justice in University of Dhaka we proposed that this is the high time to draw our footprint in that sector. To secure the victim's right and to give them benefit along with the various standing legislations, now we need to emerge our thinking for creating such organization for the restoration and social positive movement.

If we can create an Organization to build support for Victims-driven Restorative Justice we need to:

1. Highlight the work who are doing restorative justice around the world and provide opportunities to tell their stories through the media/press and social media.

2. Develop public policy models and legislation to expand the use of victims-driven restorative justice
a) provide analysis of legislative proposals or existing statutes related to justice reform and restorative justice,
b) disseminate and make available analyses on key public policy proposals;

3. Partner with others to launch pilot projects and model programs to test new restorative justice approaches;

4. Support evidence-based research in the field
a) partner with those doing the research, and
b) disseminate the research conducted;

5. Conduct training on victims-driven restorative justice including educating members, supporters and the public on lobbying effectively on restorative justice;
a) recruit legislative advocates (i.e. lobbyists) and provide training to make them more effective in making the case for victims-driven restorative justice
b) provide guidance to advocates

6. Recruit and educate victims of violent crime to support the work.

7) Durge victims to tell their stories and assist in providing a platform for them to speak out
b) host crime victim panels on restorative justice;

8. Create and expand a legislative network inside RJ composed of:
a) grassroots supporters around the globe;
b) key contacts who support goals and have access to key public officials, correctional officials, etc.

9. Create media opportunities to provide visibility through the use of film, television, radio, online social media venues.

10. Speak nationally and internationally on the work.

11. Examine and speak out on wrongful convictions. Work with those who have been wrongfully convicted and seek to right the wrong of wrongful convictions. Restorative justice applies to miscarriages of justice since the real offender has not been found in such cases while an innocent person is doing time for a crime he has not committed. No victim of violence wants to see an innocent person in prison or on death row for a crime he did not commit.

We can make awareness against:

☞ Poverty
☞ Environment degradation
☞ Trafficking of human being
☞ Sexual exploitation of women and children
☞ International abduction of children
☞ The drug trade
☞ The arms trade
☞ Criminal associations, gangs
☞ Terrorist attacks

We responses way from oppressive rejection to partial acceptance to inclusion in an egalitarian framework:

☞ Corruption
☞ Segregation
☞ Assimilation
☞ Multiculturalism
☞ Inter-culturalism
☞ Integration
☞ Anti-racism

We task in disaster situations:

☞ Assessing need,
☞ Co-ordinating and delivering goods and services,
☞ Assisting family reunification,
☞ Supporting individuals and communities to rebuild lives, develop resilience and build capacity to minimize risk during future disasters,
☞ Advocating, lobbying and mobilizing for change that prevents future disasters,
☞ Developing allies across a range of stakeholders, and
☞ Translating scientific messages into understandable language.

 Conclusion:

 So by analyzing all the abovement discussion now it is safe to state that an organization for Restorative Justice is very necessary to establish a victim driven Justice system. We need to raise our voice for the victims and their surrounding right. If we can establish such organization then we can play a vast role for enhancing Justice, equity and good conscience. We can make a role for minimizing the backlog of cases, free legal aid services, professional mediation, restoration and the protection of victims’ rights, if we able to make a organization relating with Restoration Justice. So, now we need to think deeply for introducing a new social justice system where we can ensure the proper natural Justice. “Let’s make society better with aid”.......

What is Restorative Justice :

Restorative Justice can help us keep our balance to distinguish between the living people who were hurtful and the internalized ones who are now part of our neurobiology.
Those who harmed us may never change, but once they become part of us, they seem to partake in our impulse towards healing.

Why VOIL?

The VOIL Agency's vision is a future in which restorative justice is the normal response to crime. For this to take place, there will need to be changes in perspectives, policies and practices. The Centre is active in all three areas.

CHANGING PERSPECTIVES ABOUT JUSTICE

While growing numbers of people support restorative justice, many more either have not heard of it or question its appropriateness because of assumptions they have about the meaning of justice. This is true of professionals and policymakers in the criminal justice system and of pastors and parishioners in church pews. We provide a number of ways to help them explore restorative justice as an alternative perspective on justice in the aftermath of crime.

CHANGING JUSTICE SYSTEM POLICIES

Perspectives help shape criminal justice policies. Policies are reflected in laws and regulations adopted by the government. For restorative justice to be the normal way of responding to crime, criminal justice policy impediments must be removed and new policies implemented to encourage its use. We engage in reform projects to incorporate restorative policies in justice systems.

CHANGING HOW VICTIMS AND OFFENDERS ARE TREATED

Policies provide structure. Programs reflecting those policies complete creation of a restorative response to crime. Programs put hands and feet to restorative policies. Our programs provide victims with support in the aftermath of crime, create in-prison communities of restoration for offenders, and bring victims and offenders together in conversation about crime and justice.

The VOIL-Consultant Firm for Justice & Reconciliation is a program of Victim & Offender Intermediary Firm. Its mission is to develop and promote restorative justice in criminal justice systems around the world.

WHAT WE DO

We are a non-profit organization, our goals are to provide
training in classroom social & emotional competencies, trauma support,
youth/adult advocacy, youth panel and circle
practices through an interactive proven curriculum.

This can repair harm and build school community relationships, ensure youth/adult
accountability, increase school safety, and decrease school suspensions/expulsions. 

The VOIL is an organization that cultivates positive school climate and culture, hold students accountable for their actions
and provide teachers a multi-tier system of support that focuses on "collaborative power" vs "power over".

The VOIL also provides a "youth driven, youth lead" school conference model full of positive activities, workshops, speakers and much more that invest in our youth. We are the village to raise our youth and dismantle school to prison pipeline by supporting social emotional behaviors.
